These General Terms and Conditions of Sale govern the contractual relationship between atelier &LAB and any person making a purchase via the website
https://atelierandlab.com.
Any order placed on the website implies full and unconditional acceptance of these GTC.

2. Products

The products offered for sale are described and presented with the greatest possible accuracy.
However, photographs are non-contractual and may show slight variations due to the handcrafted nature of the products.

atelier &LAB reserves the right to modify its product range at any time without prior notice.

3. Prices and Currencies

Prices are displayed in the customer’s local currency (USD, EUR, JPY, CAD, etc.) for information purposes only.
However, all transactions are processed exclusively in euros (€) and credited to the bank account of atelier &LAB.

VAT is not applicable pursuant to Article 293 B of the French General Tax Code (micro-enterprise regime).

Standard shipping costs are included in the sale price, unless exceptionally stated otherwise.

Payment is due immediately at the time of order via the secure payment methods available on the website (credit cards, PayPal, Apple Pay, Google Pay, etc.).

4. Orders and Payment

Any validated order constitutes acceptance of these GTC.
Payment is made online through the secure platforms offered on the website.

Orders will only be processed and shipped after full receipt of payment.

5. Delivery

Shipping Areas

France, European Union, Canada, United States, United Kingdom, Switzerland, Hong Kong SAR, Japan, South Korea, Norway, Singapore.
(We do not currently ship to destinations not listed above.)

Estimated Delivery Times

France: 3 to 5 business days
European Union: 5 to 10 business days
Other destinations: 7 to 14 business days

Delivery times are provided for information only and may vary depending on the carrier or customs procedures.

Tracking & Address

A shipping confirmation email with a tracking number is sent upon dispatch.
The customer is responsible for the accuracy of the delivery address provided.

In case of an incorrect or incomplete address, atelier &LAB cannot be held responsible for delays or lost parcels. Any reshipment may result in additional charges at the customer’s expense.

Receipt of the Parcel

The customer must check the condition of the parcel upon delivery.
Any anomaly must be reported within 48 hours, with supporting photographs.

Delays & Force Majeure

atelier &LAB cannot be held responsible for delays attributable to the carrier, customs procedures, or cases of force majeure.

6. Customs Duties and Local Taxes

For deliveries outside the European Union, customs duties or local taxes may be required by the authorities of the destination country.

These charges remain the exclusive responsibility of the customer.

7. Right of Withdrawal and Returns

In accordance with applicable law, the customer has 14 days from receipt of the product to exercise their right of withdrawal.

Products must be returned new, unused, and in their original packaging.
Return shipping costs are borne by the customer, except in the case of an error attributable to atelier &LAB.

Refunds will be issued within a maximum of 14 days after receipt and inspection of the returned item, using the same payment method as the original transaction.

Exception – Custom-Made Products

Pursuant to Article L221-28 of the French Consumer Code, personalized or made-to-order products are not subject to the right of withdrawal.

Exception to the right of withdrawal – Gift cards

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to gift cards once the code has been delivered to the customer by electronic means.

Any gift card order is final and cannot be refunded or exchanged.

8. Legal Warranties

Products benefit from:

The legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code)
The warranty against hidden defects (Articles 1641 et seq. of the French Civil Code)

9. Liability

atelier &LAB cannot be held liable for damage resulting from improper use of the purchased product.

In all cases, the liability of atelier &LAB is strictly limited to the amount of the order.

10. Personal Data

Personal data are collected solely for the purpose of processing orders.
In accordance with the GDPR, customers have the right to access, rectify, and delete their personal data.

11. Governing Law and Disputes

These GTC are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
Failing that, the French courts shall have exclusive jurisdiction.

11. Gift card

Nature: the gift card is a means of payment and not a physical product.
Delivery: by e-mail (code).
Validity: 2 years.
Use: can be used once or several times.
Refunds: non-refundable / non-exchangeable.
Loss / theft: the responsibility of the customer.
